App Terms of Use

Hello There 

 

These Terms of Use (“Terms”) are effective as of 10 June 2024. 

 

We hope you enjoy using our Scripty (“App”). Scripty’s objective is to provide you a convenient way to store your Electronic Prescriptions (also referred to as ePrescriptions). Please read these Terms before accessing or using the App.  

 

We encourage that you provide us feedback – the good and the bad so that we can provide You with an enjoyable App experience. 

 

1.0 Your Agreement 

 

This Agreement is between a user of the App (“You”, “Your”) and Oexa Pty Ltd (“Our”, “We”, “Us”). 

 

  1. By downloading and using the App, you agree to comply to all the Terms. If you do not agree to these Terms, do not access the App.  

  2. We may amend these Terms from time to time, so you must check them regularly. Once the Terms are updated, they will be effective as soon as the Terms are made available. Your continued use of the App following any changes means that You accept and agree to any changes We may make. 

  3. We may at any time for any reason: modify the App; discontinue operation of the App; suspend access to the App; remove the App from sale; interrupt operation of the App and update the App for fixes, features, services, or improvements. 

  4. As long as You comply by these Terms, We grant you a limited, non-transferrable, non-exclusive licence to use the App on your devices. This App is for your personal, non-commercial use only. 

  5. Most importantly, you acknowledge that the App is not a health service provider, and we cannot prescribe or provide medical advice. Please seek advice from a healthcare professional.  

 

2.0 Your Account 

 

  1. You must create an account with Us to access the App. 

  2. You are responsible for your sign-in and account information, including your password. 

  3. Your account is non-transferrable. 

  4. You may only use this App if you are aged 18 years or over, or if you are under 18 years of age with the consent of a parent or legal guardian.  

  5. Your email address or contact details associated with your account or sign-in may be used by Us to communicate to you about the App or your account. 

  6. You can delete your account at any time. Please note that when you delete the app off your device, it does not remove your account from our system. You must go into your account and confirm to delete your account.

3.0 Your Obligations  

 

These are your responsibilities: 

  1. You will keep your account information secure.  

  2. You will provide accurate information to the best of your ability. 

  3. If you are managing an account on behalf of someone else, you warrant that you have the legal authority to do so. 

  4. You must have internet access and a compatible mobile or handheld device. 

  5. You are responsible for ensuring your device meets the minimum specifications. 

  6. You are responsible for updating the App to the latest version available. 

  7. You will notify us if you suspect fraudulent behaviour or unauthorised use of your account. 

 

You must not: 

  1. Use another person’s details without their permission or impersonate another person. 

  2. Provide false, misleading, or deceptive information in the completion of any electronic record. 

  3. Use the App for any illegal activities or fraudulent behaviour. 

  4. Use the App to defame, harass, threaten, or conduct in behaviour that prevents any other person from using the App or the services that are related in the App. 

  5. Modify, adapt, translate, or reverse engineer any part of the App. 

  6. Reproduce, copy, distribute, resell, or otherwise use the App for any commercial purpose (subject to third-party rights). 

  7. Purposely tamper, break, or transmit viruses or defects, trojan horses or similar, to prohibit the use of the App. 

  8. Repeatedly create fake accounts. 

  9. Use any means to retrieve or index any part of the App. 

 

4.0 Termination of your Account 

 

  1. We reserve the right to immediately terminate, suspend or limit your access to the App, if we reasonably believe that you have breached these Terms. 

  2. We may also exclude access to our App at any time at our sole discretion. 

  3. We may discontinue development or support for the App and the related services within the App without prior notice.  

  4. We will not be responsible or liable for your losses due to the termination of your account or discontinuance of the App.  

 

5.0 Electronic Prescriptions 

 

The App enables you to store ePrescription tokens. You acknowledge that: 

 

  1. When you add in an ePrescription token into the App, the App connects to Oexa’s Managed Intermediary to retrieve information about the prescription. Oexa’s Managed Intermediary is a conformant system in line with requirements set out by the Australian Digital Health Agency. 

  2. This may include information and not limited to: Name of the medication;  Who the medication is prescribed for; Number of repeats; and  Validity of the ePrescription.

  3. We cannot change and/or modify the original ePrescription information that is provided to us.  

  4. We may present information about your ePrescription to help you with fulfilling your ePrescriptions at a Pharmacy. 

  5. You should check the information on your ePrescription before fulfilling your medication. 

  6. If you have any concerns about your ePrescriptions, you should contact your Doctor or Pharmacy.

6.0 MySL  (Active Script List) Integration

 

  1. The App enables you to connect one or more Active Script Lists to your account. The Active Script List functionality is provided via an integration with MySL (“My Script List”), an Active Script List Registry operated by Medication Knowledge (ABN 47 622 493 967). You acknowledge that:

    1. The functionality that Scripty provides with respect to the MySL adheres to Australian Government legislation, and restrictions that the MySL operator has put in place for connecting mobile applications. These restrictions include, but are not limited to the, following:

      1. Initial registration for a MySL must be completed outside of the App, typically at a Pharmacy or Doctor’s practice. A healthcare professional will be responsible for verifying your identity and initiating the MySL registration and consent process.

      2. Linking of the App to a MySL requires the use of a MySL ‘Activation Code’. This code can be provided to you by a healthcare professional that:

      • has access to your MySL, and

      • is using software that supports the provision of this code.

      • Some pharmacy and doctor software does not yet support the sharing of a MySL ‘Activation Code’.

  2. When you link a MySL to the App, the App connects upon your request, and/or periodically, to Oexa’s Managed Intermediary to retrieve information about that MySL. Oexa’s Managed Intermediary is a conformant system in line with requirements set out by the Australian Digital Health Agency. The information retrieved may include, but is not limited to:

    1. Details of the patient to which the MySL relates,

    2. Currently active prescriptions on the MySL, if any, and

    3. The healthcare organisations have been granted access to the MySL, if any.

  3. This information is retrieved to allow you to manage the linked MySL within the App.

  4. If you are linking a MySL to the App on behalf of another person, you acknowledge that you have the valid authority and consent to do so.

  5. The contents of a specific MySL are not controlled by the App. The App provides a representation of the MySL contents as received from the MySL operator.

  6. The MySL is not a script history service, and only provides information about currently active prescriptions. Specifically, contents of the MySL will only include prescription data for active prescriptions for which the patient did not withdraw their consent at the point of prescribe. The  App makes a best effort attempt to maintain a script history based on the information it receives from the MySL, but it cannot guarantee completeness.

  7. The MySL integration allows you to control the visibility of scripts on a MySL. This allows you to individually hide or unhide scripts from other healthcare professionals who have access to your MySL. The App is required to make this functionality available to users as a condition of its integration with the MySL.

  8. The MySL integration allows you to manage access that healthcare organisations have to a MySL. Specifically, you may revoke a healthcare organisation’s access to a MySL, or re-grant access that was previously revoked. It is not possible grant access to a new healthcare organisation from within the App.

  9. You may unlink a MySL from the App. This does not delete the MySL itself. To delete a MySL, you must contact the MySL operator.

  10. If you have any concerns about a MySL or its contents, you should contact your Doctor, Pharmacy, or the MySL operator.

 

7.0 Online Ordering of Electronic Prescriptions

Scripty enables the digital submission of electronic prescriptions from You to a pharmacy. You can send order requests to pharmacies that accept these requests. When placing an Online Order for the fulfilment of an electronic prescription, You understand and acknowledge the following::

  1. You have the legal authority to request the supply of the prescription(s) added to the request.

  2. Scripty will collect, and share with the selected pharmacy, and sub-processors, the following information, to facilitate the request: contact name, phone number, electronic prescription tokens and identifiers, and optionally, order notes and generic substitution preference.

  3. The selected pharmacy may contact You, to fulfil the request, or otherwise as a customer of the pharmacy.

  4. Your selected pharmacy may accept or reject the request at their sole discretion, and Scripty does not influence a pharmacy’s decision to process the request.

  5. By requesting the fulfilment of an electronic prescription via Scripty, You are entering into an agreement for the supply of goods from the selected pharmacy.

 

Scripty is not liable, nor responsible for, the accuracy of the data provided on the selected pharmacy, and Scripty is unable to provide remedy for concerns relating to the interactions between You and the selected pharmacy, including but not limited to: quality, price, fulfilment times, cancellation of request, refunds, returns, collection and/or delivery issues.

 

8.0 Content on the App 

 

  1. We try our best to provide accurate Content in the App. However, we do not warrant or guarantee the information that is provided by suppliers to be accurate, reliable, complete or error-free.

  2. The App may contain links to third-party websites and services. In doing so: 

  3. We are not advocating or endorsing the use of the website or product and services available  

  4. We are not responsible for the content, accuracy, product or services available from third-party services or websites 

  5. You acknowledge that engaging in the third-party services or websites is at your own risk 

  6. Your use of the App and the information you read, use or act on is solely at your own risk.

9.0 Intellectual Property Rights 

 

We’ve worked hard on our App!  

  1. All intellectual property rights in the App are either owned or managed by Us or the third-party licencing to Us to use their Content.  

  2. This applies for the App as originally downloaded by you and all subsequent downloads or software updates. 

  3. You must not reproduce our App, use our graphics including screenshots of the App for commercial use without written consent from Us. 

  4. We reserve the rights to grant licences to use the App and its Content to third parties. 

 

10.0 Warranties and disclaimers 

 

We’ll do our reasonable best. However, you acknowledge that: 

  1. We do not warrant that the App, Content, or Services including third-party systems is error-free or without defects. 

  2. Content on the App is subject to change without notice. 

  3. The quality and availability of the App and related services may be outside our reasonable control. 

 

11.0 Liability 

 

  1. To the extent permitted by law, including the Australian Consumer Law, We will not be liable for any direct, indirect, consequential, special or exemplary loss, damages or expenses - irrespective of the manner in which it occurs - which may have occurred due to your download of the App or use of App and/or the Content contained on it, or as a result of the inaccessibility of this App and/or the fact that certain Content contained on it are incorrect, incomplete or not up-to date. 

  2. We will not be liable to you for any of the following losses or damage (whether such losses were foreseen, foreseeable, known or otherwise): (a) loss or damage to equipment (b) loss of emotional well-being (c) loss of data; (d) loss of revenue or anticipated profits; (e) loss of business; (f) loss of opportunity; (g) loss of goodwill or injury to reputation; (h) losses suffered by third parties.

12.0 Privacy and Your Personal Information

We care about your Privacy. 

​

  1. Your use and sharing of your personal information are in accordance with Our Privacy Policy (oexa.co/privacy-policy). 

  2. By accessing the App, You agree that we may collect and use technical data and related information (including device and system) to support App software updates, product support and other relevant services related to the technology. 

  3. If you add ePrescription tokens, your personal information and associated information with the ePrescription token may be used for support purposes which may include sharing it with information technology (IT) partners. You can remove ePrescription tokens from the App at any time. 

  4. You will co-operate with Us to provide information as requested by government agencies, law enforcement agencies, regulatory bodies and or as required, authorised or permitted by the law. 

 

13.0 Jurisdiction  

 

Your use of the App and these Terms are governed by the laws of Queensland, Australia.

Definitions

The capitalised terms used throughout the terms have the meaning set out here:

 

App means the application provided by Us relating to products and services available 

 

Content means all copyright, database rights text, titles, icons, graphics, layout, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, software code and the design, structure, selection and other intellectual property rights.

Electronic Prescription is a digital version of a paper prescription which comes in the form of a ‘token’. You will receive a separate token for each medication you are prescribed. 

 

Terms mean these terms of use governing Your use of the Application. 

 

Our, We or Us means Oexa Pty Ltd (91 640 736 910) 

 

You or Your means the person to which the device is registered or the person authorised to use the device, upon which the Application is installed.
